These are the terms and conditions governing your use of the website http://www.gemastra.com/ (herein after referred to as "the Site") constitutes your binding obligations towards GemAstra.com (hereinafter referred to as GemAstra.com) ("User Agreement").
This Agreement is effective upon acceptance in registration for new registering users(all users/dealer/merchants), GemAstra.com may amend the User Agreement at any time by posting the amended terms on the Site. All amended terms shall automatically become effective thirty days after they are posted on the Site and any subsequent use of the Site shall be governed by such amended terms. In addition, we will notify you in accordance with your Notification Preferences.
This Agreement may not be otherwise be amended except in a writing signed by you and GemAstra.com. The User Agreement was last revised on June 20, 2018. You are advised to regularly check for any amendments or updates to the terms and conditions contained in this User Agreement. If any clause of the User Agreement shall be deemed invalid, void or for any reason unenforceable, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the User Agreement. You must read, agree with and accept all of the terms and conditions contained in this User Agreement and GemAstra.com's Privacy Policy, which include those terms and conditions expressly set out below and those incorporated by reference, before you may become a member of GemAstra.com.
We strongly recommend that, as you read this User Agreement, you also access and read the information contained in the other pages and websites referred to in this document, as they may contain further terms and conditions that apply to you as a GemAstra.com user. By accepting this User Agreement, you also agree that your use of GemAstra.com will be governed by the User Agreement and Privacy Policy posted on those websites.

ABOUT PRODUCTS:
We warrant that on delivery the Products shall:
• Conform in all material respects with their description.
• Be of satisfactory quality.
• Be fit for any purpose we say the Products are fit for.
• Be free from material defects in design, material and workmanship.
• Comply with all applicable statutory and regulatory requirements for selling the Products in India.
• This warranty does not apply to any defect in the Products arising from fair wear and tear, willful damage, accident, negligence by you or any third party, if you use the Products in a way that we do not recommend, your failure to follow our instructions, or any alteration or repair you carry out without our prior written approval.
• We will take reasonable steps to pack the Products properly and to ensure that you receive your order in good condition.
• These terms apply to any repaired or replacement Products we supply to you in the unlikely event that the original Products are faulty or do not otherwise conform to these terms.
• We have products inventory with original product image, we also have some dummy products with sample image which can be customized.
ABOUT PRICING AND PAYMENT:
Prices for Products/Services offered by us are described on the Site and are incorporated into the terms by reference. Unless specified otherwise, all prices are in Indian rupees (“INR”) and are inclusive of VAT/CST. Prices, Products and Services may change from time to time at our discretion.
You shall make payment according to our payment terms; and by such methods as are indicated on the Site. Without prejudice to the foregoing, we retain a security interest in the Products until full payment is made.
ABOUT DELIVERY OF PRODUCTS:
Depending on your pin code, we may not be able to deliver Products to you, nor allow you to pay by certain payment methods. We apologies for any inconvenience.
The time taken for delivery tends to vary according to the destination; however, we make our best efforts to ensure that the order is delivered on time.
ABOUT CANCELLATION BY THE COMPANY:
There may be certain orders that we cannot accept, and therefore, we reserve the right, at our sole discretion, to refuse or cancel any order. Some reasons may include limitation on quantity available for purchase; errors in pricing or Product information or certain issues identified by our fraud avoidance department or any other issue which we identify for not accepting the order. We also reserve the right to ask for additional information for accepting orders in certain cases. We will notify you in case your order has been cancelled fully or partially or if any additional information is required to accept your order.
ABOUT CANCELLATION BY BUYER:
1.Once an order is placed, it can only be cancelled by you within 3 hours of order or before we have packed it.
2.We are pleased to deliver our jewellery to a number of destinations around the country, with no extra shipping costs.
3.The standard delivery duration of our product ranges from 2 to 6 days.
4.The standard duration for the free delivery of our product ranges from 2 to 6 days.
5.For your peace of mind, all parcels are trackable. All delivery times are stated in working days and do not include Weekends and Holidays.
6.We provide COD (Cash on Delivery) option for some major metropolitan and urban areas of the country only for products worth upto 500/-.
7.We endeavour to deliver orders within the standard delivery times, delays caused may be beyond our control and due to our individual delivery services.
8.If you experience any issues with delivery or require assistance with your order, please get in touch with our Help Team and they will happily assist you.
GENERAL:
If any court or competent authority decides that any of the provisions of these terms are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law. If we fail, at any time while these terms are in force, to insist that you perform any of your obligations under these terms, or if we do not exercise any of our rights or remedies under these terms, that will not mean that we have waived such rights or remedies and will not mean that you do not have to comply with those obligations. If we do waive a default by you that will not mean that we will automatically waive any subsequent default by you. No waiver by us of any of these terms shall be effective unless we expressly say that it is a waiver and we tell you so in writing. Nothing in these terms will reduce your statutory rights relating to faulty or wrongly described Products.
GOVERNING LAW AND JURISDICTION:
These terms shall be construed in accordance with the applicable laws of India. The courts at delhi shall alone have exclusive jurisdiction in any proceedings arising out of these terms.
SPECIFIC PROMOTION TERMS AND CONDITIONS:
No other promotional offer/ discount offer/ Cash back voucher will be applicable with the free gift. Only one offer is at one time. It doesn't entitle the customers any surety with regard to the benefits of the offer Co. reserves the right to amend/modify/cancel/withdraw/discontinue this offer and/or amend the terms & conditions applicable at any time for any reason at its sole discretion without any prior information whatsoever.
The Terms & Conditions, set herein, shall be governed by the Laws of India. All disputes arising out of or in connection with the purchase, shall be subject to the exclusive jurisdiction of competent courts in delhi only. All disputes and complaints are to be notified with co.within 15 days fom purchase. Complaints received after that will not be considered and entertained.
